Terms and conditions

These terms and conditions are available to read below.

  1. The University of Manchester, through The University of Manchester Library [hereafter referred to as The UML], agrees to supply the applicant the requested image(s), subject to the terms and conditions expressed in this document: in consideration for which the applicant agrees to pay The University the sum specified.

  2. If paying by invoice, then credit terms for customers are strictly 30 days from the date of the invoice.

    1. If the invoice is not paid within 30 days then The University shall be entitled to:
      1. charge interest on the outstanding amount at the rate of 8% above the base rate of the National Westminster Bank PLC at the time when payment became due under this clause above, accruing daily.
      2. decline to deliver any further goods to be supplied under this contract or any other application placed by the individual or company with The University, until payment has been received in full of any amount outstanding, and payment has been made by the applicant in advance for any goods not yet delivered without thereby incurring any liability to the buyer.
  3. In cases where the customer cancels an order (or part thereof), The University reserves the right to charge the customer a cancellation fee up to the full tariff price the order that has been cancelled.

  4. If the customer has failed to complete the required bibliographic information, and therefore failed to specify fully their requirements, The University reserves the right to cancel the order at the point of receipt. If The University supplies the incorrect image because the customer has failed to complete the required bibliographic information then The University reserves the right to charge the full tariff price of the image provided.

  5. Reproductions will only be made within the UML Preservation Policy. When the University is unable to fulfil an order (or part thereof) due to the Preservation Policy, no charge for the order (or part thereof) will be made to the customer.

  6. Customers should note that the quality of reproductions supplied by The University is dependant on the condition of the original item to be reproduced. In the event of the legibility of the reproduction being poor for any other reason not related to the original item, The University will replace the defective reproduction without additional charge, so far as is reasonably practical.

  7. The turn around times quoted by The University are estimates and are applicable to the supply of services from the UML Imaging Services. The times quoted are from the receipt of payment to the time that the completed order is dispatched to the customer. The turn around times are subject to the following conditions:

    1. That the item requested is held within The University collections and is available for retrieval at the time the order is processed and it does not require special treatment to allow reprographic work to take place. Every effort will be made by the University through the UML Imaging unit to obtain the material ordered by the customer, however the supply of any reproduction cannot be guaranteed.
    2. That the customer has provided full and clear bibliographic details.
    3. That all order details are correct, complete and legible.
    4. That difficult to handle material, large orders and special requirements will fall outside of the advertised turn around times and will need to be agreed with the individual customer.
  8. No Imaging or related services will be offered by The University on Saturdays, Sundays, English Bank Holidays or during the University closure period throughout Christmas and New Year. Turn around times do not include these periods

  9. Copyright. All material is subject to UK Copyright Law. Requests for a complete reproduction of material which is in copyright will require written copyright permission from the copyright holder before The University will accept the application form. The customer must attach the original permission from the copyright holder to the application (photocopies are not acceptable). A signature to the application indicates an agreement to abide by copyright legislation and The University of Manchester copyright.

  10. The University does not accept responsibility for non-delivery or delays incurred in receipt of the application or receipt by the customer of the reproduction(s) where delivery is via a third party (e.g. the Royal Mail or a courier service). The University will not accept liability for damage caused in transit.

  11. The University reserves the right to change its published prices without prior warning. (An up to date price list is readily available on The Library web pages).

  12. The University shall not be liable for any delay or failure to fulfil applications by reason of Force Majeure events.

  13. The University owns and retains at all times the copyright on all reproductions produced. Customers may not reproduce any material supplied for any reason (including academic or personal, and whether for profit or not) without prior written permission from the UML. Customers who wish to reproduce material supplied should apply directly to The UML for the applicable fees and permission.

  14. These terms and conditions of sale supersede all other terms and conditions, including any terms or conditions, or descriptions, or statements as to the delivery, quality or performance of the goods or their suitability for any purpose in any literature relating to the goods and override and exclude other terms and conditions, descriptions and statements as to quality and performance or suitability of the goods stipulated or referred to by the applicant whether in the application form or otherwise.

  15. No representative or agent of The University has any authority to agree any terms or make any representations that are inconsistent with these terms and conditions. The University will not be bound by any statements made by any person purporting to act on The University’s behalf as to these terms and conditions or any statements as to the delivery, quality, performance or suitability of the goods unless any such statement is specifically confirmed in writing by a duly authorised officer of The University and annexed to an application or contract.

  16. Except in case of death or personal injury caused by The University’s negligence, The University shall not be liable to the applicant by reasons of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, for any loss of business or profit or any direct or consequential loss, and the entire liability of the University under or in connection with the contract shall not exceed the price of the goods, except as expressly provided in these conditions.

  17. Where the goods are to be delivered in instalments, each delivery shall constitute a separate contract and failure of The University to deliver any one or more of the instalments in accordance with these conditions or any claim by the applicant in respect of anyone or more instalments shall not entitle the applicant to treat the contract as a whole as repudiated.

  18. Any dispute arising under or in connection with these terms and conditions or the sale of the goods shall be referred to arbitration by a single arbitrator appointed by agreement, or (in default) nominated by the President of the Chartered Institute of Purchasing and Supply from time to time in office.
